Terms & Conditions

  1. Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.
  2. Entry is open to residents of Australia who have a valid email address and are either an individual purchasing the Promotion Product for their personal use or have the authority to purchase the Promotion Product and enter the competition on behalf of a business, (“Eligible Entrant”). Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this competition and their immediate families are ineligible to enter.
  3. The competition commences at 9am Australian Eastern Daylight Standard Time (“AEDST”) on Tuesday 8 October 2013 & closes at 11.59pm AEDST on Sunday 22 December 2013 (“Competition Period”).
  4. To be eligible to enter, purchase a 1kg can of NESCAFÉ BLEND 43 that has a “WIN $250 Chill Out Gift Card every week” competition sticker attached to the lid from a participating food service distributor (“Eligible Purchase”).
  5. To send an entry you will need to submit an original recipe that uses NESCAFÉ BLEND 43 as an ingredient. Follow these steps to enter:
    1. Choose your method of entry;
      1. Use your smartphone to scan the QR code to go to the entry form; or
      2. visit www.nescafe-75th.com.au/atwork; then
    2. Follow the prompts, to add your contact details including the last 6 digits of the NESCAFÉ BLEND 43 product barcode
    3. Submit a recipe that uses NESCAFÉ BLEND 43 as an ingredient. The recipe must be described in no more than 500 words.
  6. Entry is limited to no more than once per calendar week and per Eligible Entrant provided an Eligible Purchase has been made. The Promoter reserves the right to require an entrant to provide proof of purchase for their entry in order to claim a prize.
  7. The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any entrant or groups for tampering with the entry process, including but not limited to making multiple entries that are not associated with a separate Eligible Purchase or for submitting an entry that is in accordance with these terms and conditions.
  8. The prize is an EFTPOS Gift Card with $250 credit. The gift card can be used anywhere in Australia that accepts EFTPOS, subject to merchant’s discretion. The gift card is valid for 12 months from date of activation. The gift card is subject to the issuer’s terms and conditions which can be read at www.giftcardplanet.com.au/disclaimer.php. One prize will be awarded each week of the Competition Period, (total of 11 prizes).
  9. This competition is a game of skill and chance plays no part in determining the identity of the prize winners. All valid entries received each week of the Competition Period will be judged on their merit and the entry judged to be the best received each week based on creativity and originality will win the prize.
  10. Judging will be completed at Suite 2, 2 Northcote Street, St Leonards NSW 2065 each week for 11 weeks. Judging for each week’s entries will be concluded by close of business on Wednesdays on the following dates:
    1. Week 1 (entries received from 8 to 13 October) on 16 October 2013.
    2. Week 2 (entries received from 14 to 20 October) on 23 October 2013.
    3. Week 3 (entries received from 21 to 27 October) on 30 October 2013.
    4. Week 4 (entries received from 28 October to 3 November) on 6 November 2013.
    5. Week 5 (entries received from 4 to 10 November) on 13 November 2013
    6. Week 6 (entries received from 11 to 17 November) on 20 November 2013.
    7. Week 7 (entries received from 18 to 24 November) on 27 November 2013.
    8. Week 8 (entries received from 25 November to 1 December) on 4 December 2013.

  11. Total prize pool is valued at $2,750.
  12. Prize is not transferable & cannot be taken as cash.
  13. The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.
  14. Each entry becomes the property of the Promoter. All details will be held in accordance with the Nestlé Privacy Policy which can be accessed by visiting www.nestle.com.au or calling 1800 005 510.
  15. Promoter’s decision is final and no correspondence will be entered into.
  16. The winner should look to the manufacturer of products and provider of services awarded as prizes for all warranties. However, these terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Competition and Consumer Act 2010) where to do so would contravene that statute or cause any part of these terms and conditions to be void.
  17. In the event that the prize item is unavailable despite the Promoter’s reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value.
  18. By entering the competition, each entrant agrees to the use of their recipe for printing, broadcast, publicity and promotional purposes, and the Promoter’s website/s without compensation, and agrees that the Promoter will own all intellectual property rights, including copyright, in any such material. It is a condition of accepting any prize that the winner acknowledges that the Promoter acquires the entry caption for use for its commercial purposes and agrees not to object to any such use on the basis of any moral right.
  19. Prizes will only be delivered in Australia and each winner should allow 28 days from the conclusion of judging for delivery of their prize.
  20. If for any reason this Competition is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Competition, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the Competition. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.
  21. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Competition.

  1. How do I submit an entry?
    A. Buy any specially marked 1kg can of NESCAFÉ BLEND 43 that has a “WIN a $250 Chill Out Card” sticker attached to the lid. Either scan the QR code with your smart phone or visit www.nescafe-75th.com.au/atwork to enter your contact details, your barcode and a recipe.
  2. Where do I find my barcode?
    A. The barcode is on the side panel of the label. Be sure to only enter the last 6 numbers.
  3. How many times can I enter?
    A. Entry is limited to no more than once per calendar week and per Eligible Entrant provided an Eligible Purchase has been made. The Promoter reserves the right to require an entrant to provide proof of purchase for their entry in order to claim a prize.
  4. Where can I purchase a specially marked NESCAFÉ BLEND 43 1kg can?
    A. Order NESCAFÉ BLEND 43 1kg “WIN a $250 Chill Out Card " cans exclusively through Nestlé Professional food service distributors; it is not available in retail supermarkets.

Nestlé supports permission based marketing. Where consent exists, Nestlé may enter your details into a database for the purpose of contacting you directly about Nestlé, its brands, special offers, samples, consumer research and other promotions.

Winners details and a description of the prizes will be entered on a database to comply with record-keeping requirements of relevant Australian State and Territory lotteries and gaming legislation. Details will also be published in accordance with the terms and conditions of each promotion.

Entries are held for up to 13 months after the last prize draw. After this, they are then destroyed in a secure manner.

Disclosure
Except where you are otherwise notified, Nestlé does not sell, rent or otherwise make available any personal information to third parties. Nestlé outsources certain business functions to other organisations. For this purpose, and only for the purpose of providing services to Nestlé, personal information may, as required, be transferred to or handled by: :

Sending to a friend
